Terms of Service

Last updated: August 1, 2026

These Terms of Service ("Terms") govern your access to and use of the ChinaAPI service at chinaapi.ai and dash.chinaapi.ai (the "Service"), operated by ApexNodes (Hong Kong) Limited ("ApexNodes", "ChinaAPI", "we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Recharge & Refund Agreement. If you do not agree, do not use the Service.

1. The Service

ChinaAPI is an API gateway. We provide a single, OpenAI-compatible API endpoint through which you can send requests to third-party artificial-intelligence models — including large language models and image and video generation models operated by their respective providers (the "Models"). We aggregate access, handle authentication and metered billing, and route your requests to the upstream provider.

ChinaAPI does not own, train, host, or control the Models. The Models are operated by third parties, and their behavior, availability, and output are determined by those providers. We act solely as an access and billing intermediary.

2. Definitions

  • Account — your registered ChinaAPI account.
  • Credits / Balance — prepaid, U.S.-dollar-denominated value in your Account that is consumed as you use the Service.
  • API Key — a secret token that authenticates requests made from your Account.
  • Input / Output — the content you submit to a Model and the content a Model returns.

3. Where the Service Is Offered

3.1 The Service is offered from Hong Kong SAR. It is directed to users in the markets we publish from time to time, and prices are quoted in U.S. dollars.

3.2 The Service is not offered to, and is not directed at, residents of the European Economic Area, the United Kingdom, Switzerland, or mainland China. We do not market the Service in those territories, we do not accept local payment methods for them, and we do not intend to establish a commercial presence there. If you are resident in one of those territories, please do not register for or use the Service.

3.3 If we determine that an Account is operated from a territory listed in Section 3.2, we may decline to open it, suspend it, or close it and refund any unused purchased Credits in accordance with the Recharge & Refund Agreement.

3.4 You are responsible for complying with the laws of your own jurisdiction, including any export-control, sanctions, or content restrictions that apply to you.

4. Eligibility and Account

4.1 You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind it.

4.2 You are responsible for the accuracy of your registration information, for the security of your credentials and API Keys, and for all activity that occurs under your Account. Notify us promptly at [email protected] if you suspect unauthorized use. Do not share, sell, or transfer your Account or API Keys.

5. Acceptable Use

You agree not to use the Service to:

5.1 violate any applicable law or regulation, or infringe the rights of others;

5.2 generate, distribute, or facilitate content that is illegal, that sexually exploits or endangers minors, that promotes violence, terrorism, self-harm, or unlawful discrimination, or that constitutes fraud, malware, spam, or unauthorized data scraping;

5.3 violate the terms, acceptable-use policies, or usage restrictions of any upstream Model provider — those policies apply to your use of the corresponding Models through the Service;

5.4 attempt to bypass, disable, or interfere with rate limits, quotas, security controls, or the integrity of the Service;

5.5 resell, sublicense, or provide the Service to third parties as a standalone product without our prior written consent; or

5.6 misrepresent Model Output as human-generated where disclosure is legally required, or use Output in a manner that violates any Model provider's restrictions.

We may set and adjust rate limits and may refuse, throttle, or filter requests that we reasonably believe violate these Terms.

6. Credits, Pricing, and Billing

6.1 The Service is prepaid. You add Credits to your Account and they are consumed as you make requests. Pricing is metered per usage (for example, by token count, request, or generated media) at the rates published at dash.chinaapi.ai/pricing.

6.2 We may change published rates. Rate changes apply only to usage occurring after the change takes effect; we do not reprice usage you have already consumed. We will publish the updated rates before they take effect and, for increases affecting Models you have recently used, will give notice through the Service where practicable.

6.3 New accounts may receive promotional trial Credits. Promotional Credits are not purchased value, may expire, and are non-refundable.

6.4 Purchases, balance validity, invoicing, and refunds are governed by the Recharge & Refund Agreement.

6.5 You are responsible for any taxes associated with your use of the Service, except taxes on our net income. Where a payment provider or merchant of record collects tax at checkout, that amount is shown before you pay.

7. Third-Party Models and Output

7.1 Model Output is generated by third-party providers and is provided "as is." We do not guarantee that Output is accurate, complete, current, lawful, non-infringing, or fit for any purpose. You are responsible for evaluating Output before relying on it.

7.2 As between you and ChinaAPI, and subject to each Model provider's terms, you retain your rights in your Input and in the Output you generate. You are responsible for your Input and for how you use Output.

7.3 To answer your call, we route your Input to the provider operating the Model you selected. Many of the Models we offer are hosted in mainland China; others are hosted elsewhere. Each provider processes your Input under its own terms and privacy practices. See our Privacy Policy.

7.4 Model availability depends on third parties. Upstream providers may add, rename, re-version, restrict, reprice, or withdraw Models, and may change rate limits or output behavior, in some cases with little or no advance notice to us. We will give notice through the Service where practicable, but such changes are not a breach of these Terms. If a Model you rely on becomes unavailable, your remedy is to use an alternative Model or to request a refund of unused purchased Credits under the Recharge & Refund Agreement.

8. Availability and Support

The Service and the Models are provided on a commercially reasonable, best-effort basis. We do not guarantee uninterrupted or error-free operation, and upstream availability is outside our control. Current status is published at chinaapi.ai/status. Support is available at [email protected] and via the channels in Section 15.

9. Intellectual Property

The Service, including its software, dashboard, documentation, and branding, is owned by ChinaAPI and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. All rights not expressly granted are reserved.

10. Disclaimers

To the maximum extent permitted by applicable law, the Service and all Output are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and availability.

11. Limitation of Liability

To the maximum extent permitted by applicable law, ChinaAPI will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenues, data, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid to ChinaAPI in the three (3) months preceding the event giving rise to the claim, or (b) fifty U.S. dollars (US$50).

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, for death or personal injury caused by negligence, or any consumer rights that applicable mandatory law does not permit us to exclude.

12. Indemnification

You agree to indemnify and hold harmless ChinaAPI from any claims, damages, liabilities, and expenses arising out of your Input, your use of Output, your violation of these Terms, or your violation of any law or third-party right.

13. Suspension and Termination

13.1 You may stop using the Service at any time. You may request closure of your Account and a refund of eligible unused Credits under the Recharge & Refund Agreement.

13.2 We may suspend or terminate your Account, with or without notice, if you violate these Terms, if required by an upstream provider or by law, or to protect the Service or other users. For suspensions due to abuse or fraud, unused Credits may be withheld pending review.

13.3 If we terminate your Account for convenience rather than for cause, we will refund unused purchased Credits.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above and, where appropriate, communicated through the Service. Your continued use after changes take effect constitutes acceptance.

15. Governing Law and Disputes

15.1 These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict-of-laws rules.

15.2 The parties will first attempt to resolve any dispute informally by contacting [email protected]. If that fails, the courts of Hong Kong SAR have non-exclusive jurisdiction.

15.3 If you are a consumer, nothing in this Section deprives you of the protection of mandatory consumer-protection rules of your country of residence, including any right to bring proceedings in your local courts where the law of that country gives you that right.
